Julia Talarick obtained a dismissal in Arbitration Forums, Inc. in favor of KLRW’s insurer client. There, the claimant insurer filed a demand for arbitration to recoup over $300,000 in PIP payments on behalf of two injured pedestrians, arguing that the vehicle that struck the pedestrians was a commercial vehicle, not required to carry PIP coverage in New Jersey. KLRW argued that although the vehicle, an SUV, was registered commercially, it was a private passenger vehicle required to maintain PIP and therefore the claimant insurer had no claim for reimbursement against KLRW’s client.
