July 24, 2019Mike Chuven and Jon Altman recently won summary judgment on behalf of a crane professional at a construction site accident in the Bronx in which material is alleged to have toppled over and crushed the plaintiff. Based on the discovery provided by Plaintiff and co-defendant, KLRW moved for summary judgment prior to depositions occurring. Despite opposition, the Court was convinced that KLRW’s client did not cause the accident, and dismissed all of the causes of action including negligence, and violations of Labor Law §§ 200, 240, and 241.
