Jim Lisovicz obtained a dismissal of a defamation, product disparagement, and trade libel action against his clients. The action involved alleged defamatory statements made in the context of a Board of Education election and a local property development dispute. The plaintiff alleged that our clients defamed the plaintiff by referring to his as a “slumlord.” The court dismissed the action on our motion to dismiss for failure to state a claim, agreeing with our position that the alleged defamatory statement was not of or concerning the plaintiff, and was a statement of opinion, and therefore not defamatory. The court dismissed all claims as to our clients.
