Mark S. Hanna, Esq. persuaded a Hudson County Superior Court Judge to dismiss, with prejudice, an action involving a plaintiff’s allegation that a public entity’s acts or omissions caused the plaintiff to sustain significant injuries, including a torn knee meniscus. Mark argued that the factual record did not contain any credible objective medical evidence of a permanent injury to support plaintiff’s claim for damages. The Court agreed that the plaintiff was unable to satisfy the requirements of the New Jersey Tort Claims Act, N.J.S.A. 59:9-2(d), and dismissed the plaintiff’s complaint with prejudice against the Firm’s public entity client.
